California Privacy Rights

This Privacy Notice to California residents should be read in conjunction with AmericanAgTM’s Privacy Policy. This Privacy Notice is provided under California law, including the California Privacy Act, Cal. Civ. Code 1798.100 et seq. (the “CCPA”). This notice supplements AmericanAgTM’s Privacy Policy by explaining your privacy rights if you are a California resident, providing our “notice at collection,” and providing certain mandated disclosures about our treatment of California residents’ information, both online and offline.

California residents are protected as “consumers” by the CCPA with respect to personal information. A number of statutory exceptions apply under the CCPA and to these CCPA Disclosures, including the following:

  1. Personal information collected from job applicants, hired employees and staff (including officers and directors), and independent contractors and business members to the extent such information is collected and used solely within the employment context.
  2. Personal information collected by a business that is emergency contact information from job applicants, hired employees and staff (including officers and directors), and independent contractors and business members to the extent that personal information is collected and used solely within the context of having an emergency contact on file.
  3. Personal information that is necessary for the business to retain and administer benefits for job applicants, hired employees or staff (including owners, officers, and directors), and independent contractors and business members to the extent that personal information is collected and used solely within the context of administering those benefits.
  4. Information reflecting a written or verbal communication or transaction between AmericanAgTM and an employee or representative of another organization (i.e., business, non-profit, or government agency), where the communication or transaction occurs in the context of (a) AmericanAgTM conducting due diligence on that other organization, or (b) AmericanAgTM providing or receiving a product or serve to or from such organization.

A. Notice of Collection of Personal Information

AmericanAgTM only collects personal information from you if you register on our Website or fill out a form. In such instances, we collect these categories of information: name, contact information, commercial information, and geolocation data.

AmericanAgTM collects this information so we can best serve you, including fulfilling your requests for services or events that you elect to enroll in.

California residents also have the right to “opt out” of the “sale” of their “personal information” to “third parties” (as those terms are defined in the CCPA and described below).

B. CCPA Mandatory Disclosures

AmericanAgTM makes the following disclosures for purposes of compliance with the CCPA:

  1. AmericanAgTM collected the following categories of personal information in the last 12 months: name, contact information, commercial information, and geolocation data.
  2. The sources of personal information from whom we collected are: directly from our guests, third-party sites or platforms that you are linked to for surveys and events, and analytics tools.
  3. The business or commercial purposes of collecting personal information for purposes described herein and in the Privacy Policy.
  4. Under the CCPA, “selling” means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to another business or a third party for monetary or other valuable consideration. AmericanAgTM does not sell personal information for monetary or other consideration. In the past 12 months, AmericanAgTM “sold” the following categories of information: commercial contact information.
  5. The business or commercial purposes of “selling” personal information is for third-party companies to perform services on our behalf, such as invitations and surveys, or to provide commercial contact information to other event attendees.
  6. We do not “sell” personal information of known minors under 16 years of age.

C. Your Rights 

1. Right to Access

If you are a California resident, you have the right to request, up to two times each year, access to categories and specific pieces of personal information about you that we collect, use, disclose, and sell.

2. Right to Delete

If you are a California resident, you have the right to request that we delete personal information that we collect from you, subject to applicable legal exceptions.

3. Right to Opt Out of Sale of Personal Information

If you are a California resident, you have the right to “opt out” of the “sale” of your “personal information” to “third parties” (as those terms are defined in the CCPA).

4. Process to Make a CCPA Request

Making Access and Deletion Requests:

To make an access or deletion request, please submit your request here or email privacy@aaic.com. Before completing your request, we may need to verify your identity. We may request additional documentation or information solely for the purpose of verifying your identity.

Instructions for Authorized Agents Making Access and Deletion Requests:

You may also use an authorized agent to submit an access or deletion request on your behalf. Authorized agents may submit access and deletion requests to privacy@aaic.com. An authorized agent must have your signed permission to submit a request on your behalf or provide proof that they have power of attorney in accordance with California Probate Law. Authorized agents that are business entities must be registered with the California Secretary of State to conduct business in California. Before completing requests from authorized agents, we may contact you directly to confirm you have given your permission and/or verify your identity.

Making Requests to “Opt Out” of the “Sale” of “Personal Information”

To submit a request to opt out of the sale of your personal information, you may email privacy@aaic.com with the subject line “Do Not Sell Info.” You may also use an authorized agent to submit a request to opt out on your behalf if you provide the authorized agent signed written permission to do so. Authorized agents may submit requests to opt out by emailing privacy@aaic.com. You have the right not to receive discriminatory treatment for the exercise of your privacy rights conferred by the CCPA.

Shine the Light Act

If you are a California resident, California Civil Code Section 1798.83 permits you to requests information regarding the disclosure of your personal information by AmericanAgTM to third-parties for the third-parties’ direct marketing purposes. We take great pride in the relationships and are dedicated to treating your personal information with care and respect. Pursuant to California Civil Code Section 1798.83(c)(2), AmericanAgTM does not share personal information with affiliates or others outside of AmericanAgTM for those parties’ direct marketing unless the user consents.
